TPD & Superannuation

HAVE YOU BEEN UNABLE TO WORK  FOR MORE THAN 6 MONTHS DUE TO INJURY OR ILLNESS?

DID YOU HAVE SUPERANNUATION AT THE TIME YOU STOPPED WORKING?

Superannuation and Total Permanent Disability (TPD) Claims

Most people automatically have Total and Permanent Disability (TPD) insurance attached to their superannuation account.

TPD insurance provides financial protection for when you suffer a permanent injury, illness or disability that stops you from working.

TPD insurance is designed to provide a lump-sum payment to help cover medical expenses, ongoing care costs, and other financial needs that may arise due to the disability. The coverage includes disabilities resulting from both accidents and illnesses.

TPD claims can be complex and there are usually numerous steps involved in making a claim. I can give you the legal support, advice and guidance that you need during this uncertain time.

Eligibility

To be eligible for a TPD insurance claim, you must meet the specific definition of total and permanent disability as outlined in your policy. This typically involves demonstrating that your disability is likely to be permanent and that it prevents you from working in any gainful employment for which you are reasonably qualified.

The claims process for TPD insurance begins with notifying the insurance provider of the disability and initiating a claim. Most TPD policies have specific conditions or exclusions that affect the eligibility for benefits.

The insurer will evaluate the claim based on the policy’s definition of total and permanent disability and the supporting evidence provided.

If the claim is approved, you will receive a lump-sum payment determined by the policy’s coverage limits.

Making a Claim

If you are injured or have a sickness that prevents you from working on a permanent basis you may be able to make a TPD claim.

I can help you navigate this complex process. I will review your policy to determine your eligibility and assist and represent you throughout the claims process.

It is important to obtain expert legal advice as TPD insurance policies vary in their definitions, coverage limits, and exclusions.

Legal Fees: “No Win, No Fee”

I operate a fully funded “No Win, No Fee” system. In other words, unless you are successful in your claim you will not be charged any costs and disbursements by me. You can rest assured that you will not pay any money at all during the claim. Only at the successful conclusion of your matter will you be charged legal fees.
